Golflist app: terms of use
These terms cover the Golflist app for iPhone and iPad. By installing or using the app you accept them. They sit alongside Apple's standard Licensed Application End User Licence Agreement, and where the two differ, these terms apply. The website has its own terms and conditions. Who we are
The app is published by Droplist Ltd, a company registered in England and Wales, trading as Golflist. Droplist Ltd also runs golf-list.com. You can reach us through the contact page.
What the app does
The app shows golf equipment sold by retailers and the price each of them is asking for it, so you can see who stocks what you want and who is cheapest. It does not sell anything, hold stock, take payment or handle orders. When you tap through to a shop, anything you buy is a contract between you and that retailer under its own terms, and any question about payment, delivery, returns, warranty or fitting is a matter for them.
Your licence to use the app
We give you a personal, non-exclusive, non-transferable licence to install and use the app on Apple devices that you own or control, as allowed by the App Store terms. You may not copy the app, modify it, reverse engineer it, extract its data in bulk, resell it, or use it to build a competing service. The licence ends if you break these terms or delete the app.
Prices, stock and product information
Product names, descriptions, specifications, prices, discounts and stock are supplied by the retailers through their product feeds and shown automatically. Feeds are refreshed regularly but they are not live: a price can change, a discount can end and an item can sell out between a retailer publishing its feed and you opening the app. Feeds contain mistakes of their own, and where shops describe the same club differently our grouping of them can be wrong.
The information in the app is a guide, not an offer to sell, and we give no warranty that it is accurate, complete or current. Check the price, the specification and the availability on the retailer's own page before you buy. The retailer's page is what counts.
Affiliate links
Most links from the app to retailers are affiliate links. If you follow one and buy something, Golflist may be paid a commission by the retailer or by an affiliate network acting for them. It costs you nothing and does not change the price you pay. Commission does not buy a position in the app: products are ranked by price, by discount or by how many shops stock them, and the same rules apply to retailers we earn from and retailers we do not.
Wishlist
Products you save are stored on your device only. They are not backed up by us, they do not move between devices, and they are gone if you delete the app.
Notifications
If you allow notifications we may send you deals and news about the app. You can switch them off at any time in the iOS Settings app. How notifications are delivered, and what that involves, is set out in the privacy policy.
Images, trade marks and content
Product photographs are supplied by the retailers in their feeds and belong to those retailers or to the brands that make the products. They are shown to identify the product being compared. Brand names, model names and logos are the trade marks of their owners, and their appearance in the app does not imply any endorsement of, association with or sponsorship by Golflist. Retailer logos are provided by Logo.dev. If you own rights in an image or a mark shown in the app and want it removed, write to us and we will take it down. Everything else in the app, including its design, its groupings and its written text, belongs to Golflist.
No advice
Nothing in the app is advice about what equipment suits you. Shaft flex, lie angle, loft and grip size all matter and none of them can be judged from a feed. Get fitted.
Availability and liability
The app is provided as it is and as it is available. We do not promise that it will be uninterrupted or error free, and we may change, suspend or withdraw any part of it, or the data behind it, at any time. To the fullest extent the law allows, Golflist is not liable for any loss arising from use of the app or from reliance on anything shown in it. Nothing here limits liability that cannot lawfully be limited, and nothing here affects your statutory rights as a consumer.
Apple
Apple is not a party to these terms and has no obligation to provide maintenance or support for the app. Apple is not responsible for any claim relating to the app, including product liability claims, claims that the app does not conform to a legal requirement, or claims under consumer protection law. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.
Links to other sites
Where the app links to a retailer or any other third party, we have no control over that site and take no responsibility for its content, its terms or its privacy practices.
Changes
We may update these terms. The version published on this page is the one that applies, and using the app after a change means you accept it.
Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without affecting any right you have as a consumer to bring a claim where you live.
